RoadLens – TERMS OF SERVICE

These Terms of Service (“Terms”) are a binding agreement between you (“you,” “User,” or “Customer”) and Valkyrja Interactive LLC (“Valkyrja Interactive,” “Company,” “we,” “our,” or “us”). They govern your access to and use of the RoadLens mobile application, website, and related services (collectively, the “Services”).

IMPORTANT: By accessing or using any part of the Services you confirm that

you have read and agree to these Terms;

you are at least 13 years old (or the local age of digital consent); and

you have legal capacity to enter into these Terms.
If you do not agree, discontinue use immediately.

1. Scope of Services

1.1 Service Description

The Services may include, without limitation:

A mobile app providing a nationwide map of live, publicly available road-camera images.
Camera-status badges, favorites, slideshow, and other viewing features.
A voluntary game in which users guess camera locations.
An ad-supported free tier and an optional one-time in-app purchase (“Remove Ads”).
Support and ancillary services.

1.2 Informational Use Only

Camera feeds and other data are provided for informational purposes only. They are not a substitute for official traffic advisories, navigation systems, or safe driving practices. Real-world conditions may differ from what is displayed.

2. Eligibility, Accounts & Security

Eligibility – You must be at least 13 years old (or older where local law requires).
Optional Accounts – Most features do not require an account. If you create one (e.g., to save a leaderboard name), you must provide accurate information and keep it current.
Security – Safeguard any login credentials; you are responsible for all activity under your account. Notify us at support@valkyrjainteractive.com of any unauthorised use.
Suspension / Termination – We may suspend or terminate access for Terms violations, suspected fraud, or legal reasons.

3. Purchases & Billing

Fees – The core app is free with a small banner advertisement. You may remove ads with a one-time in-app purchase; prices are displayed in-app and may vary by region.
Payment Processing – Apple App Store or Google Play processes payments; their terms apply.
Refunds – All sales are final except where required by law or platform policy.
Taxes – Prices may exclude local taxes; you are responsible for any applicable charges.

4. Fair-Use & Rate Limits

We may throttle or suspend usage that materially exceeds normal consumer behaviour or degrades service for others.
Automated scraping, large-scale downloading, or resale of camera images without written consent is prohibited.

5. Intellectual Property & Licence

Company Content – Software, text, graphics, and algorithms are owned or licensed by Valkyrja Interactive and protected by law.
Limited Licence – We grant you a personal, non-transferable, revocable licence to use the Services for non-commercial purposes.
Restrictions – You may not reverse-engineer, redistribute, or create derivative works without written consent.
User Content – You retain ownership of content you submit (e.g., leaderboard names) but grant us a worldwide, royalty-free licence to host and display it to operate and improve the Services.

6. Acceptable Use

You agree not to:

Violate any law or regulation.
Post unlawful, defamatory, obscene, or hateful content.
Infringe intellectual-property rights.
Introduce malware or interfere with the Services.
Attempt unauthorised access to other accounts or systems.
Use bots or automated scripts to scrape or spam.
Impersonate others or misrepresent affiliation.

We may monitor and remove content or suspend users at our discretion.

7. Third-Party Data & Integrations

RoadLens relies on camera feeds from state and local Departments of Transportation (“DOTs”) and other public sources. This data is provided “as is”; availability and accuracy are outside our control. Required attributions are displayed within the app.

8. Privacy

Our collection and use of personal information are governed by the RoadLens Privacy Policy, incorporated into these Terms by reference.

9. Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted operation. Your use is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, Valkyrja Interactive and its affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages; lost profits, data, or goodwill; or aggregate liability exceeding the greater of (a) amounts you paid in the prior 12 months or (b) USD 100.

11. Indemnification

You agree to defend, indemnify, and hold harmless Valkyrja Interactive and its affiliates from any claims or liabilities arising out of your use of the Services, your content, or your breach of these Terms.

12. Termination

We may suspend or terminate your access at any time for violations, legal compliance, or operational reasons. Upon termination, your licence ceases and certain provisions (e.g., Indemnification, Limitation of Liability) survive.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules.

13.1 Informal Resolution

Please e-mail support@valkyrjainteractive.com for any dispute and allow 30 days for informal resolution.

13.2 Binding Arbitration

If unresolved, disputes shall be settled by confidential, binding arbitration under the AAA Consumer Arbitration Rules before a single arbitrator seated in New York, NY (unless otherwise agreed).

13.3 Class Action Waiver

Proceedings must be on an individual basis; class or representative actions are not permitted.

13.4 Injunctive Relief

Either party may seek injunctive relief in court for intellectual-property or confidentiality breaches.

14. Changes to These Terms

We may update these Terms at any time. Material changes will be announced via in-app notice. Continuing to use the Services after the effective date constitutes acceptance.

15. Miscellaneous

Severability – If any provision is unenforceable, the remainder remains in effect.
Entire Agreement – These Terms supersede prior agreements regarding the Services.
No Waiver – Failure to enforce any provision is not a waiver.
Assignment – We may assign these Terms; you may not without our consent.
Force Majeure – We are not liable for delays beyond our reasonable control.
